What this tool does
Collecting overdue payments works better in stages than with a single aggressive letter. Sending certified mail first puts the other side on the defensive and usually ends the business relationship. This tool moves between a first gentle reminder, a second formal demand, and a third certified letter through a single tone control. Shifting the tone from polite to firm changes the title, the body, and the consequences paragraph together. Certified mail in Korea carries no direct enforcement power, but the post office certifies what was sent and when, which becomes evidence if you later apply for a payment order or sue. If the limitation period is close to expiring, sending a formal demand can buy you time.

How to use
- 1Choose the tone. Polite is the first reminder, neutral the formal demand, firm the certified letter.
- 2Enter sender and recipient precisely. Certified mail requires a specified address to prove delivery.
- 3Fill in the claim: transaction date, item, amount, original due date. Specificity makes it hard to dispute.
- 4Always include a deadline and bank account. Without account details they cannot pay you.
- 5Copy the document, or export the AI prompt to refine the wording for your situation.
Late damages
Late damages accrue at the statutory rate from the day after the due date until full payment. Commercial obligations carry 6% per year (Commercial Act Article 54); otherwise 5% applies (Civil Act Article 379). For example, KRW 10,000,000 overdue by 90 days on a commercial claim: 10,000,000 x 6% x 90/365 = about KRW 148,000. An agreed contractual rate takes precedence. Higher rates may apply once litigation begins under the Act on Special Cases Concerning Expedition of Legal Proceedings.
Stage examples
1st - Gentle reminder
The goal is preserving the relationship. Leave room for an oversight and add a line telling them to disregard it if already paid. Do not warn of consequences yet.
2nd - Formal demand
Set out the facts in numbered paragraphs and state a deadline. Noting that late damages accrue often accelerates payment.
3rd - Certified mail
Warn of a payment order or litigation. It is filed at a post office in three copies, kept by the sender, the recipient and the post office.
Frequently asked questions
Does certified mail have legal force in Korea?
Not by itself. The post office only certifies what was sent and when. However, if it requests performance of an obligation it can qualify as a formal demand under the Civil Act.
Does it interrupt the limitation period?
Not on its own. Under Civil Act Article 174 you must file a lawsuit, payment order, or attachment within six months for the interruption to take effect retroactively. The six months run from the date of delivery, not the date of sending.
Can I extend the period by sending it repeatedly?
No. Case law holds that among repeated demands, only one made within six months before the judicial claim has effect. Repeated mailings cannot extend it indefinitely.
How long is the limitation period for goods payments?
Commercial claims are generally five years (Commercial Act Article 64). However, the price of goods sold by a merchant and construction claims often fall under the three-year short limitation period of Civil Act Article 163, so check the nature of the claim.
How do I actually send it?
Prepare three identical copies and file them at a post office as certified content mail. Sender, recipient and post office each keep one. It can also be filed through the Internet Post Office.
