Article 2 (Use, repairs and restoration) 1. The Lessee uses the premises only for and makes no change of use or structure without written consent. 2. What this tool does

A lease contract sets the terms for renting a building or land. At signing everyone looks at the deposit and the rent; the argument arrives at move-out, over how far restoration must go, what the maintenance fee covered, and what was deducted from the deposit. Article 10(1) of the Commercial Building Lease Protection Act lets a tenant request renewal between six months and one month before expiry, which the landlord may not refuse without a statutory ground, and Article 10(2) confines that right to a total lease term of ten years including the first. This builder targets shops, offices, warehouses and land, and pushes the move-out questions back to the signing table.

How to use

Deposit settlement

Deposit returned = deposit − rent arrears − unpaid charges − restoration cost. Require the landlord to give a written breakdown of any deduction.

A shop with a KRW 30m deposit and KRW 1.5m monthly rent, vacated two months in arrears: KRW 3m of arrears plus restoration cost is deducted, with a written breakdown to check against.

Renewal window

For a lease expiring 31 March 2026, renewal must be requested between 1 October 2025 and 28 February 2026 — six months to one month before expiry.

Fit-out restoration

Signage and lighting were installed. A special term such as 'signage and lighting removed, wall penetrations filled' settles the scope before move-out.

Frequently asked questions

Can this be used for a residential lease?

Not recommended. The Ministry of Justice standard housing form embeds pre-contract checks — prior fixed-date claims, unpaid national taxes, small-deposit thresholds — that a homemade contract cannot replace. The official source is linked at the bottom of the forms hub.

Does the renewal right apply to every commercial lease?

Only to leases the Commercial Building Lease Protection Act covers, which the Act delimits by deposit size. That threshold amount was not verified for this guide, so it is not stated here — confirm coverage before signing. The renewal window and the ten-year ceiling are as the Act provides.

How far does restoration go?

As far as the contract says. That is why the clause states that natural wear from ordinary use is excluded. For a substantial fit-out, record the scope with photographs at installation.

Can the maintenance fee be raised later?

According to the method the contract sets. Without a stated basis and procedure, every increase becomes a negotiation, so listing the items and the calculation at signing serves both sides.
